License terms for CISflight

The use of the CISflight E-Books is subject to the below-mentioned terms and conditions. By paying the license fee and using CISflight E-Books, the user signifies acceptance of these terms and conditions.

Disclaimer

All materials, information, software, products and services included in or available through CISflight E-Books at this website or as E-Book files are provided "as is" and "as available". The contents are provided without warranties of any kind, either express or implied.

Program and data errors are possible. CISflight E-Books and data are provided for advisory purposes only. CIS-Computer Innovations & Service GmbH ("CIS") assumes no responsibility for the correctness or accuracy of same. In particular, CIS does not warrant that the contents are accurate, reliable, complete, comprehensive, correct or up-to-date, that this website will be available at any particular time or location, that any defects or errors will be corrected or that the content is free of viruses or other harmful components. CIS shall endeavour to correct any error brought to its attention.

CIS grants the Client a non-exclusive license to download CISflight E-Books, transfer them to a single suitable reading device at a time and use its contents in strict accordance with the terms of this agreement.

The use of the provided information via CISflight E-Books is restricted to AIS pre-flight purposes according to Chapter 8 of Annex 15 of the Chicago Convention or for interstate military AIS pre-flight purposes on behalf of a State. Such use for flight preparation is under the sole responsibility of the user.

Without a prior written approval of CIS, the Client shall not:

1. disclose, sell, assign, lease or otherwise provide Data which he does not own to other Clients or to third parties or
2. commercially exploit or have commercially exploited Data which he does not own.

The Client is responsible not to transfer this usage license to any third party unless he:

1. ensures that these license terms for CISflight, espcecially the usage restriction for flight preparation are still maintained and
2. provides the CIS detailled address information about the receiver of the usage license.

To the extent permitted by law, CIS shall not be liable for any direct, indirect, punitive, incidental, special or consequential damages (including, but not limited to, damages for loss of business profits, business interruption, loss of programs or information) that results from the use or inability to use the CISflight E-Books, in particular for, but not limited to, errors or omissions in the contents of the CIS website the published CISflight E-Books or the consequences of their use, nor for inaccurate transmission or misdirection, even if CIS has been advised of the possibility of such damage.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis.

It is the users' responsibility to make sure that they are using the most up-to-date information available. 

CIS may change materials on the website without prior notice.

Copying of the materials in RAM or other temporary storage device necessary for the browsing of the CIS website or reading CISflight E-Books is authorized as well as saving CISflight E-Books to one single suitable reading device at a time (as if they were physical books).  All other uses are strictly prohibited.

Planned Maintenance

To ensure that CISflight E-Books are available at the highest possible levels, occasional downtimes for planned maintenance are necessary. During these downtimes, the system will be unavailable.
